1. Acceptance1. 條款接受
These Terms are an agreement between you and Jen Ho Tai, an individual developer based in Taichung, Taiwan ("we", "us"). By creating an account or using 食跡 Moments ("the app"), you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the app.本條款為你與個人開發者 Jen Ho Tai（所在地台灣台中，以下稱「我們」）之間的協議。當你建立帳號或使用 食跡 Moments（以下稱「本 App」），即表示你同意本條款及我們的隱私權政策。若你不同意，請勿使用本 App。
2. Early release2. 早期版本
食跡 Moments is an early release. Features may change as we improve the app, and it may occasionally contain bugs or be interrupted for maintenance. Please don't rely on it as your only record of anything important.食跡 Moments 為早期版本。隨著我們持續改進，功能可能變動，並可能偶有錯誤或因維護而中斷。請勿將其作為任何重要事項的唯一紀錄。
3. Eligibility & your account3. 使用資格與你的帳號
You must be old enough to form a binding contract and to consent under the law where you live (and at least 13). If you are at least 13 but under 18 (a minor with limited legal capacity under the Taiwan Civil Code), you confirm that your parent or legal guardian has reviewed and consented to these Terms before you create an account. To download the app from the App Store you need an Apple ID. Keep your login details secure and give us accurate information; you're responsible for activity under your account.你必須達到能訂立具約束力契約、以及你居住地法律所要求的同意年齡（且至少 13 歲）。若你已滿 13 歲但未滿 18 歲（依中華民國民法為限制行為能力人），你確認在建立帳號前，已取得父母或法定代理人對本條款的審閱與同意。從 App Store 下載本 App 需要 Apple ID。請妥善保管你的登入資訊並提供正確資料；你須對你帳號下的活動負責。
4. Your content4. 你的內容
You keep ownership of the content you create (your moments, photos, notes, and messages). You grant us the limited permission needed to store, display, and share that content to operate the app for you and the people you share it with. You're responsible for what you post, and you confirm you have the right to share it.你保有你所建立內容（你的紀錄、照片、筆記與訊息）的所有權。你授予我們為了向你及你分享的對象提供 App 所必需的有限權限，以儲存、顯示與分享該內容。你須對你張貼的內容負責，並確認你有權分享之。
5. Acceptable use5. 使用規範
Please don't:請勿：
- break the law, or post content that is illegal, hateful, harassing, or infringes others' rights;違反法律，或張貼違法、仇恨、騷擾或侵害他人權利的內容；
- impersonate others or misuse another person's data;冒充他人或濫用他人資料；
- attempt to hack, overload, scrape, or reverse-engineer the app or its security;嘗試入侵、癱瘓、抓取或還原工程本 App 或其安全機制；
- use the app to spam other users or to do anything that harms others.利用本 App 對其他使用者發送垃圾訊息，或從事任何傷害他人的行為。
We require a safe community. We operate a zero-tolerance policy toward objectionable content — including defamatory, hateful, harassing, obscene, sexually explicit, or violent material, and content that infringes others' rights — and toward abusive behaviour. To keep the community safe:我們致力維護安全的社群環境，對不當內容（包含誹謗、仇恨、騷擾、淫穢、色情或暴力內容，以及侵害他人權利的內容）及濫用行為採取零容忍政策。為維護社群安全：
- Report — moments, photos, profiles, and messages each have a Report control that sends the content to our moderators for review.檢舉 — 紀錄、照片、個人檔案與訊息皆設有「檢舉」功能，檢舉後會將該內容送交我們的審查人員審閱。
- Block — you can block any user. Once blocked, their profile, content, and messages disappear from your experience and they can no longer interact with you or invite you.封鎖 — 你可封鎖任何使用者。封鎖後，對方的個人檔案、內容與訊息將從你的體驗中消失，且無法再與你互動或邀請你。
- 24-hour action — our moderation team reviews reports and will remove violating content and suspend or terminate abusive accounts within 24 hours.24 小時處置 — 我們的審查團隊會審閱檢舉，並於 24 小時內移除違規內容，並對濫用帳號予以停權或終止。
6. Place info & bookings6. 餐廳資訊與訂位
Place details (such as opening hours, address, and contact information) come from Google Maps/Places and may be out of date or inaccurate — please confirm the details yourself before relying on them. When your group agrees on a place, the app may show booking or contact links for that venue. Any booking is made directly between you and the venue; we are not a party to it and we don't guarantee availability, pricing, or that a reservation will be honoured.餐廳資訊（例如營業時間、地址與聯絡方式）來自 Google 地圖／Places，可能過時或不正確 — 在依賴前請自行確認。當你的群組對某家餐廳達成共識時，本 App 可能顯示該店家的訂位或聯絡連結。任何訂位均為你與店家之間直接進行；我們並非當事人，亦不保證有空位、價格或訂位必獲履行。
7. No warranty7. 免責聲明
The app is provided "as is" and "as available", without warranties of any kind to the fullest extent permitted by law. We don't guarantee it will be uninterrupted, error-free, or that any content or third-party information (including Google Places data) is accurate.本 App 以「現狀」及「現有」基礎提供，於法律允許之最大範圍內不附任何形式之擔保。我們不保證其不中斷、無錯誤，亦不保證任何內容或第三方資訊（包含 Google Places 資料）之正確性。
8. Limitation of liability8. 責任限制
To the extent permitted by law, we are not liable for indirect or incidental damages, or for lost data or content, arising from your use of the app. Nothing here limits liability that cannot be limited by law.於法律允許之範圍內，對於因你使用本 App 而生之間接或附隨損害，或資料、內容之遺失，我們不負賠償責任。本條款不限制依法不得限制之責任。
9. Ending your use9. 終止使用
You can delete your account at any time directly in the app — Settings → Account → Delete account — which permanently and irreversibly removes your data (see the Privacy Policy). You can also stop by deleting the app. We may suspend or end access — for example, to protect users or if these Terms are broken.你可隨時在 App 內直接刪除帳號 — 設定 → 帳號 → 刪除帳號 — 這會永久且不可逆地移除你的資料（見隱私權政策）。你也可以刪除 App 以停止使用。我們亦可能暫停或終止存取 — 例如為保護使用者或於本條款遭違反時。
10. Governing law10. 準據法
These Terms are governed by the laws of the Republic of China (Taiwan), and the Taiwan Taichung District Court shall be the court of first instance for any dispute, without prejudice to mandatory consumer-protection rights you may have where you live.本條款以中華民國（台灣）法律為準據法，並以台灣台中地方法院為第一審管轄法院；惟不影響你依居住地法律所享有之強制性消費者保護權利。
